How Property Division Works In Colorado

Colorado is an equitable state in terms of property division. This means that all assets and debts are divided fairly between spouses, but not necessarily equally. The courts consider any number of factors when determining how to divide property in a divorce:

  • The length of the marriage
  • The ages of each spouse
  • The economic circumstances of each spouse
  • The earning capacity of each spouse
  • Non-monetary contributions to the marriage, such as time spent raising children
  • Other factors

Property is either classified as marital or separate. Marital property includes property acquired during the marriage and is jointly owned by both spouses. Separate property is property owned individually by one spouse and not the other, generally from before the marriage occurred.
